Wholesale Terms and Conditions
1. General Overview
These terms and conditions govern the wholesale purchase of products from Pacha Indigenous Art Collection, (the "Seller") by the wholesale buyer (the "Buyer"). By placing an order, the Buyer agrees to adhere to these terms.
2. Minimum Order Quantity (MOQ)
The Buyer agrees to purchase a minimum order of $500 per transaction. Orders under this amount will not be processed unless a special arrangement has been made in advance.
3. Pricing
All wholesale prices are quoted in CAD and are subject to change without prior notice. Prices are exclusive of taxes, shipping, and handling fees unless otherwise specified. The Seller reserves the right to update prices periodically.
4. Payment Terms
Payment must be made in full before the order is shipped. Accepted payment methods include:
- Bank Transfer
- Credit Card (via our secure online payment portal)
- PayPal (for orders under $2,000)
5. Shipping & Delivery
- Shipping Costs: Shipping costs will be calculated based on the weight and destination of the order and will be added at checkout.
- Lead Time: Orders for in-stock items are typically processed and shipped within 5-7 business days. Custom orders will require additional time.
- Shipping Carrier: Shipping will be handled through third party chosen by the Seller, unless otherwise agreed upon.
- Delivery Delays: The Seller is not responsible for delays caused by third-party shipping carriers or customs procedures.
6. Returns & Exchanges
- Damaged Goods: If any products arrive damaged, the Buyer must notify the Seller within 7 days of receipt with supporting evidence (photos). A replacement or store credit will be issued, depending on the nature of the issue.

Returns/Exchanges:
Due to the uniqueness and effort behind all our handmade items, we do not accept returns. Pacha Indigenous Art Collection reserves the right to deal with exchanges on a case-by-case basis.
7. Resale & Restrictions
The Buyer agrees to only resell products purchased from Pacha Indigenous Art Collection through their approved sales channels, such as their physical store or authorized online store. Resale of products via third-party marketplaces (e.g., Amazon, eBay) or to unauthorized resellers is prohibited.
8. Taxes & Duties
The Buyer is responsible for any applicable local taxes, duties, or import fees that may arise from the shipment of goods. Prices quoted do not include such fees unless otherwise indicated.
9. Order Cancellation
Orders can only be canceled if the Buyer contacts the Seller within 24 hours of placing the order. Once the order has been processed or shipped, cancellations are not accepted.
10. Confidentiality
Both parties agree to maintain confidentiality regarding any sensitive business information exchanged, including pricing, terms, and product details.
11. Liability
The Seller's liability is limited to the purchase price of any goods found to be defective or damaged upon receipt. The Seller is not liable for any consequential or incidental damages resulting from the use or resale of the goods.
12. Agreement Changes
The Seller reserves the right to modify or amend these terms and conditions at any time. Any updates will be posted on the Seller’s website and will apply to orders placed after the effective date.
13. Governing Law
This agreement is governed by the laws of the state of Ontario, Canada, and any disputes will be resolved in the jurisdiction of Toronto.
